Cohabitation Disputes

Often people choose to live together and not marry. This is known as cohabitation. When the relationship breaks down there may be financial issues that need to be resolved such as how the property you both shared is to be divided between you.

At J M Wilson Solicitors we can offer you advice on the best way to do this in an amicable way. If we can’t resolve the case through negotiation with the other party then sometimes we have to start court proceedings. Such proceedings are started in the civil courts and are known as TOLATA proceedings (short for Trusts of Land and Appointment of Trustees Act 1996) proceedings. We can guide you through those proceedings to ensure you have the correct legal advice and support required.
